Terms of service
The agreement between you and Atesen Software for the use of LeadCascade. Last updated 5 November 2026. These terms cover the service at leadcascade.atesensoftware.com.
These terms are written by the operator to describe how the service actually works. They are not legal advice. If anything here is unclear, ask us before you pay.
1. Who these terms are with
The service is provided by Samet Ateşen, trading as Atesen Software, Sakarya, Türkiye (“we”, “us”). “You” means the person using the service and, if you use it for an employer or a client, that organisation as well. You confirm you are allowed to act for them. By connecting a HubSpot account you accept these terms.
2. What the service does
LeadCascade creates HubSpot leads, together with their contacts and companies, in the HubSpot account you connect, from a CSV or Excel (.xlsx) file you upload, and only when you tell it to. It works through the HubSpot API, using the connection you authorise, and it does nothing outside the permissions you grant. For each row it finds or creates the company (by domain) and the contact (by e-mail), links them, and creates the lead linked to both. Existing contacts and companies are reused and never overwritten. It does not update existing leads, import deals or tickets, enrich data, or export.
The service works in these steps:
- you upload a file, which is read in your browser, and match its columns to lead fields;
- you press “Check the file”. The service compares the file with the properties, pipelines, owners, companies, contacts and leads in HubSpot, and shows a preview of the leads, contacts and companies it would create and the rows that need fixing. Nothing is written to HubSpot at this stage; and
- you type the confirmation phrase, and the service creates the companies, contacts and leads in batches.
A row with a problem is not sent at all. If HubSpot rejects a write, the row is marked failed and the service does not force it. If the service cannot be sure whether a step landed in HubSpot, it reads HubSpot first; a row it still cannot settle is marked for review and is never retried automatically. When the run ends you get a result with a link to each record in HubSpot and a result CSV.
3. Your file and your confirmation
You choose what to create, and you are responsible for the content of your file. Before any run, the service shows a preview of what it will create and the rows it will not send. To start the run you type the confirmation phrase IMPORT followed by the number of leads, and the number is checked. Doing so is your instruction to proceed. A preview older than 24 hours cannot be run; upload the file again. A run holds up to 1,000 rows, and a file up to 4 MB.
You are responsible for checking the preview, for downloading the result file, for having the right to put the people in your file into HubSpot (including any consent or notice that applies to them), and for making sure the import is appropriate for your business.
4. A run changes your HubSpot data
A run creates records in HubSpot. It can create companies, contacts and leads, which then appear in your HubSpot account, in its reports and in anything that reacts to new records, such as workflows and notifications. LeadCascade keeps an encrypted record of what it created so that you can use Undo (clause 5). By typing the confirmation phrase you accept this for the rows in that preview.
5. Undo
- Undo is available for 30 days. Undo is free.
- Undo deletes the leads LeadCascade created in that run. HubSpot keeps deleted records in its recycling bin, where they can be restored.
- A lead that someone worked on after the import (edited more than 10 minutes later, or with a deal) is left in place and reported. You can then deal with it in HubSpot yourself.
- Contacts and companies the run created are never deleted by Undo. The result CSV marks them so that you can review them in HubSpot.
- Undo does not use up your plan’s leads.
- Undo needs the HubSpot account to be connected. After 30 days, and once you disconnect the account, the stored records are deleted and Undo is no longer possible. Download the result file if you want to keep a record.
6. HubSpot and no guarantee of its behaviour
LeadCascade depends on the HubSpot API. HubSpot sets API limits and may change, restrict or withdraw API features, or have outages. We do not control HubSpot and we do not guarantee how its API behaves. A run may slow down, pause, skip rows or fail because of that. The HubSpot account needs the Leads object (Sales Hub Professional or Enterprise); without it the service cannot create leads. Where a step cannot be verified, LeadCascade stops that row rather than guess, and reports it.
7. Your account and your conduct
- Keep your sign-in secure, and disconnect accounts you no longer work with.
- Do not use the service to break the law, to breach your agreement with HubSpot, or to change records you have no authority over.
- Do not try to get around limits, probe other customers’ data, or run automated load against the service beyond normal use.
8. Plans and payment
- Our order process is run by our online reseller Paddle. Paddle is the seller and merchant of record for all orders. It takes the payment, issues the invoice, handles VAT and sales tax, and handles billing questions and refunds together with us.
- Prices exclude VAT and sales tax. Where tax applies, Paddle adds it at checkout and shows the total before you pay.
- A lead is counted when it is created in HubSpot: one row that finished as a lead. Rows that were skipped, failed or marked for review are not counted, and neither is Undo.
- Free: upload, check the file and preview, without limit, and the first 10 leads in each HubSpot account. The 10 leads do not renew. It is provided as it is, with no commitment on either side, and we may change or end it at any time.
- Pass: $29 once (excl. VAT/sales tax), for one HubSpot account, valid for 7 days from purchase, for up to 3,000 leads. It does not renew. Unused days and unused leads expire when the 7 days end.
- Monthly: $49 per HubSpot account per month (excl. VAT/sales tax), charged in advance, with no limit on the number of leads, paced by HubSpot’s API limits. It renews each month until you cancel. You can cancel at any time. Cancelling stops the next renewal and the plan works until the end of the period you have already paid for.
- If a payment fails and is not fixed, access to the paid features stops.
- We may change prices with at least 30 days’ notice by email. The new price applies from your next renewal, and you may cancel before it.
- Founding offer: the code FOUNDING40 takes 40% off the first payment until 30 November 2026.
- Refunds: you may ask for a full refund within 14 days of a payment, without giving a reason, and we will give it. See the refund policy.
9. Availability
We aim to keep the service available but we do not promise any particular uptime. We may take it down for maintenance, and we may stop a job or switch off job processing entirely if we believe that is needed to protect customer data.
10. No warranty
The service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that it will produce a particular outcome in your CRM. Nothing here excludes a warranty that cannot be excluded under the law that applies to you.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special or consequential loss, or for lost profit, lost revenue, lost data or lost goodwill, however caused.
Our total liability to you, for all claims taken together, is limited to the total fees you actually paid us for the service in the 12 months before the event that gave rise to the claim. If you have paid us nothing, for example on the free plan, our total liability is limited to zero, and your remedy is to stop using the service.
Nothing in these terms limits liability for fraud, or for anything else that cannot be limited under the law that applies to you.
12. Your data
What we collect, why, how long we keep it and how to have it deleted is set out in the privacy policy, which forms part of these terms.
13. Termination
- By you: disconnect your accounts and stop using the service, at any time, for any reason. Cancel a monthly plan through the billing portal in the app, or by emailing us.
- By us: we may suspend or end your access if you breach these terms, misuse the service, do not pay, or if we are required to by HubSpot or by law. Where it is reasonable, we will warn you first and give you time to fix the problem.
- On termination: jobs stop, tokens are deleted, and the retention periods in the privacy policy run their course. Fees already paid are not refunded, except where clause 8 says otherwise.
- Clauses 4, 6, 10, 11 and 15 survive termination.
14. Changes to these terms
We may update these terms. The “last updated” date above changes, and for a material change we will email you before it takes effect. Continuing to use the service after that counts as acceptance. If you do not accept, cancel and stop using it.
15. Governing law and jurisdiction
These terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Sakarya, Türkiye, have jurisdiction over any dispute arising from them. If you are a consumer, this does not take away the protection of the mandatory consumer law of the country where you live, and you may also bring a claim in the courts there.
16. General
- These terms and the privacy policy are the whole agreement between us about the service.
- If a clause turns out to be unenforceable, the rest stays in force.
- Not enforcing a clause once does not waive it.
- You may not transfer your rights under these terms without our written consent. We may transfer ours if the business is sold, and will tell you.
- We are independent. LeadCascade is not affiliated with, endorsed by, or certified by HubSpot, and nothing in these terms makes us a partner or agent of HubSpot.
